Ana María Arrarte is a Partner with Estudio Echecopar (a Member Firm of Baker & McKenzie International) in Lima, Peru. She is the leader of the firm’s Dispute Prevention and Resolution area, which includes both arbitration and litigation.

Representative Experience
  • Successfully advised Telecommunications companies in complex arbitrations initiated against the Ministry of Transportation and Communications and the Telecommunications Investment Fund (with participation of OSIPTEL) for breach of the Concession Contract and the Financing Contracts, obtaining for the client an indemnity of more than thirty million dollars.
  • Advised a Spanish investor in the distribution of natural gas by pipeline network, achieving the objective of resolving the controversy with the State in a direct negotiation stage prior to an ICSID arbitration.
  • Successfully advised a mining company in a bilingual arbitration (Spanish and English) initiated by one of the former contractors of the mining project in Cusco, achieving that the Arbitral Tribunal dismissed the claim of its counterpart, who claimed more than eight million dollars, and also ordered to verify a payment in favor of the mining company.
  • Advised a telecommunications company on disputes related to the National Backbone Fiber Optic Network, both in domestic arbitration and in investment arbitration against the Peruvian State.

We are able to assemble highly specialized teams to handle the most complex arbitrations, both national and international, in Spanish and in English, before the main arbitration centers such as the International Chamber of Commerce (ICC), the International Council for Commercial Arbitration (ICCA) and the International Center for Settlement of Investment Disputes (ICSID).

Our team has experience sponsoring clients in arbitrations on commercial (contractual, commercial, corporate), infrastructure (public and private works, controversies related to concession, property and expropriation contracts) and energy matters (electricity, hydrocarbons, and especially gas), among others.

We have participated in the most important cases in which the Peruvian state has been sued. This experience has allowed us to advise with solvency to national and foreign companies in their claims against the Peruvian state in all types of arbitration, both in preventive advice and in the formulation of claims and defenses under Peruvian law or the respective investment protection agreements. Specifically, we have experience in investment disputes with the state as regards electricity and hydrocarbons.
